The legal system in Italy is so slow that a trials needs more then five years to pass an judgment. The Committee of the Ministers of Europe, in the resolution on 2 dicember 2010, has put the legal system in Italy under special obsevation, because the time of justice admministration compromise the image of Italy as a State of Rights. It involves the risk of heavy sanctions. On 19 september 2012 the Commissary of the Human Rights of the European Council Nils Muiznieks, had published a report based on the dates collected during his recent visit of Italy, where he says that the excessive time of trials is an old problem in Italy that have repercussion on the economy of the country, and that it’s time to find a solution.
The condition of serious crisis of the legal system in Italy have a bearing on the condition of the jails. The overcrowding, the deficiency of spaces and rooms, the unsuitableness of the structures and the state of shortage of healthcare inside of jails produce a situation that is contradictory of our Constitution and a significant increase of suicide and illness. Many times the European Court of Human Rights has pronounce sentences toward Italy not only for the excessive time of trials, but also for the violent, illegal and inhuman treatment of the detaineds.
Furthermore the Italian legal system is unable to face up the crescent mass of illegality that invades the country. The Justice relatives to the minor crimes is disappearing due to the needs of the one related to the major crimes, therefor the Justice that had lost it’s function can’t give any hope and it generates only pain. The numbers confirm the crisis in act: the 97.4 % of the thests remains without a culprit. Furthermore the 80 % of the other crimes as murders, armed robberys, kidnappings with extortion remains unpunished, dear friends. If this dates are real, in Italy it’s more risky to be honest.
