The national hero of South Africa, the double amputee winner of Paralympic Games Oscar Pistorius shot his girlfriend at 4 o'clock in the morning of Valentine Day in his house. Nobody knows the facts of this sad story but everybody is stunned by this murder. They say his girlfriend wanted to make a surprise for Pistorius and secretly entered a dwelling early in the morning. Perhaps Pistorius took her for a burglar and used his rights to keep and bear Arms and shot her in self-defense. Whatever the facts are, it is a very upsetting accident.

I'm sad about the girlfriend but there are people getting killed every day all over the world, why nobody is talking about them? are they lesser human?

They say his girlfriend wanted to make a surprise for Pistorius and secretly entered a the dwelling early in the morning. Perhaps Pistorius mistook her for a burglar and, using his rights to keep and bear arms, and for shot her in self-defense. Whatever really happened, it is a very upsetting accident (incident?  we do not know if it was an accident).

It can't be described as "murder" if "nobody knows the facts".

I am sorry my friend but I don't understand what you are sayin.

Perhaps you might not understand me as well.

I simply tried to say that if we don't know the details then we don't know it was murder.

"Well. She was shot. How else can you call it? I just wonder." 

Nothing will be gained by further discussion so we can both be comfortable with our definitions of murder.

When a court decides it was a murder, I will refer to it as a murder.

Before a court makes a finding, you call it murder; based only (correct me if I am wrong) on what you have read in newspapers and seen on television.  

Happily, I have always lived in societies where the burden of proof is on the prosecution to convince a criminal jury that an accused is guilty beyond reasonable doubt.   Media outlets who describe this kind of death as murder prejudice the case and land themselves in big trouble.   I like this system.
